Plaintiff is the person who filed a Plaint which is a statement in writing of grounds of complaint made to a court of law [ie the trademark holder whose trademark has been infringed] while Petitioner is a person who makes a petition which is a request to change something, most commonly made to a government official or public entity. If made the Court its against breach of any fundamental (eq constitutional) right. Its a remedy by way of right through redressal of a wrongdoing.
